Terms of Service

Effective from [date]

Draft version. This document is waiting for a lawyer’s review and may still change.

These Terms of Service set out the rules for using the Napmoon app: reading and listening to catalog stories, creating custom stories, buying subscriptions and ordering printed books.

1. General provisions

The service provider (the “Provider”) is [Company name], [registered office address], tax identification number (NIP) [NIP number], email: [contact email address].

The “User” is an adult (a parent or guardian) who creates an account and enters into the agreement. The child uses the app under the User’s supervision.

A catalog story is a ready-made story prepared by the Provider. A custom story is a story created on the basis of data entered by the User. An audiobook is a version of a story read by a narrator.

2. Account and use of the app

Only an adult may create an account. Sign-in is via Apple, Google or an email address.

Using the app requires a device running iOS or Android and internet access.

The User must not enter any content that is unlawful, offensive or infringes the rights of others.

3. Subscriptions

Without a subscription, 3 catalog stories are available. The Reader plan ($6.99 per month) gives access to the entire catalog with audiobooks.

The Creator plan ($11.99 per month) additionally allows the User to create 10 custom stories per month. The Story Master plan ($22.99 per month) allows the User to create 20 custom stories per month, each with an audiobook.

Prices include VAT. Custom stories from the plan’s monthly limit that have not been used expire at the end of the billing period.

The subscription renews automatically every month. Payments and cancellation are handled by the App Store or Google Play – the User can cancel the subscription in their store account settings no later than 24 hours before the end of the current period.

4. One-time purchases

A custom story, and an audiobook for a custom story, can each be bought as a one-time purchase for $2.49. Purchased stories do not expire at the end of the month.

Before each purchase, the app asks the User to solve a task intended for adults.

5. Automatically created custom stories

Custom stories, illustrations and audiobooks are created automatically by artificial intelligence systems on the basis of data entered by the User.

The Provider uses safety filters and rejects ideas that are unsuitable for children. Nevertheless, the User should read each story before showing it to the child and report any inappropriate content.

6. Printed books

Any story can be ordered as a printed book. The price, delivery method and estimated processing time are shown before the order is placed.

A book with the child’s name or a dedication is a product made to the consumer’s specifications. Pursuant to Article 38(3) of the Polish Consumer Rights Act, the right of withdrawal does not apply to it. This does not affect the right to make a complaint about printing defects.

7. Right of withdrawal

A consumer may withdraw from a distance contract within 14 days, subject to the exceptions provided for in the Polish Consumer Rights Act.

If the User requests access to digital content before this period ends and has been informed that the right of withdrawal will be lost, that right expires when performance begins.

Refunds for subscriptions and in-app purchases are handled by the App Store or Google Play in accordance with the rules of the relevant store.

8. Complaints

Complaints can be sent to [contact email address]. The Provider will respond within 14 days.

Consumers may use out-of-court methods of resolving disputes, including the ODR platform: ec.europa.eu/consumers/odr.

9. Copyright

Catalog stories, illustrations, characters and recordings are protected by copyright, which belongs to the Provider.

The User may use custom stories for private purposes, including reading them to the child, printing them and sharing them with family.

10. Final provisions

The Provider will inform Users in the app of any change to these Terms of Service at least 14 days in advance.

Matters not covered by these Terms of Service are governed by Polish law, in particular the Polish Civil Code and the Polish Consumer Rights Act.
